These Terms and Conditions ("Terms") govern your access to and use of ucrfilingdesk.com and its related order flow and services (collectively, the "Services"), operated by LAV Permit Inc., a California corporation, doing business as UCR Filing Desk ("Company," "we," "us," or "our"). By using the Services, placing an order, or making a payment, you ("you" or the "Customer") agree to these Terms. If you do not agree, do not use the Services.
1. Description of Services
The Company provides a paid filing service that prepares and submits Unified Carrier Registration ("UCR") registrations on behalf of motor carriers, motor private carriers, brokers, freight forwarders, and leasing companies. The Company is a private business. It is not a government agency and is not affiliated with, endorsed by, or acting as an agent of the Unified Carrier Registration Plan ("UCR Plan"), the Federal Motor Carrier Safety Administration ("FMCSA"), or any state. You may register directly with the UCR Plan yourself; our service is optional.
2. Authorization to File on Your Behalf
By placing an order, you authorize the Company to prepare and submit a UCR registration for the USDOT number and registration year you provide, and to pay the applicable UCR fee to the UCR Plan on your behalf from the amount you pay us. You represent that you are at least 18 years old and are authorized to act for the company named in your order.
3. Accuracy of Information
You are responsible for the accuracy and completeness of the information you provide, including your USDOT number, company name, type of business, and the number of commercial motor vehicles you operate. The UCR fee is based on your fleet size. If the information you provide is inaccurate, your registration may be filed in the wrong fee bracket, may need to be corrected, or may be rejected, and you may owe additional fees. The Company is not responsible for fines, penalties, or other consequences resulting from inaccurate or incomplete information you supply.
4. Fees and Payment
The price shown before you pay is one all-in amount. It includes the UCR fee set by the UCR Plan for your registration year and fleet-size bracket, which we pay to the UCR Plan on your behalf when we file, and our fee for preparing and filing your registration. The full amount is due at the time of your order.
All payments are processed by Stripe, Inc. The Company does not collect or store your full payment card information. By submitting payment, you authorize the Company to charge your payment method for the amount shown at checkout. Prices may change for future orders but will not change for an order already paid.
5. Filing Timing and No Guarantee
We aim to file orders placed on business days the same day, and orders placed in the evening, on weekends, or on holidays on the next business day. We do not guarantee a specific filing time. Filing is subject to the availability of the UCR Plan's registration system and to acceptance of your registration by the UCR Plan. Compliance with all laws that apply to your operations remains your responsibility.
6. Cancellations and Refunds
If you ask to cancel before we have filed your registration, we will refund your payment in full. Once your registration has been filed and the UCR fee has been paid to the UCR Plan, the order cannot be cancelled and the UCR fee is not refundable by us; any refund of the UCR fee is subject to the UCR Plan's own policies. If we cannot complete your filing (for example, because the information provided cannot be verified), we will refund your payment. We may decline or cancel any order at our discretion, in which case the payment will be refunded to the original payment method.
7. Confirmation and Records
When your registration is filed, we email a confirmation to the email address you provided. Please keep it for your records. You are responsible for providing an email address you monitor. We are not responsible for non-delivery caused by an incorrect address or spam filtering.
8. Renewal Reminders
UCR must be renewed every year. If you order from us, we may email you reminders when the next year's registration opens. Each reminder includes a link to unsubscribe, and you may also ask us to stop at any time. Reminders do not mean we will file automatically; a new order is required each year.
9. Prohibited Conduct
You agree not to provide false or misleading information, misrepresent your identity or authority to act for a company, use the Services for any unlawful purpose, or attempt to interfere with or gain unauthorized access to the Site or its systems.
10. Intellectual Property
All content on the Site, including text, graphics, logos, the "UCR Filing Desk" name and branding, and software, is owned by or licensed to the Company. You may not copy or reuse it without our written consent, except as needed to use the Services.
11. Third-Party Services
The Services rely on third-party providers, including Stripe (payments), Supabase (data storage), Netlify (hosting), and Resend (email delivery). The Company is not responsible for outages or errors caused by third-party providers outside our reasonable control.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE SERVICE FEE YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow these limitations, so they may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless the Company and its officers, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, inaccurate or fraudulent information you submit, or your violation of these Terms or any law.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, except where preempted by federal law. Disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in California, unless otherwise required by law.
16. Changes, Severability, and Entire Agreement
We may update these Terms; the updated version will be posted here with a new "Last Updated" date. If any provision is found unenforceable, the rest remains in effect. These Terms and our Privacy Policy are the entire agreement between you and the Company about the Services.
